Adding to the news of recent "restructuring" of their music games franchise, Activision is finding another musical dilemma appearing on their docket. This time from a real band.  A judge has rejected Activisions attempt to throw out a 2009 suit brought against them by the band No Doubt who maintain that the publisher had used their names and likeness without permission in the game Band Hero. The lawsuit can now proceed with the band asking for an unspecified amount in damages.

"The band are bitterly disappointed that their name and likeness was taken and used without their permission. They agreed to play three No Doubt songs as a band...Activision then went and put them in 62 other songs and broke the band up [and] never even asked."

The argument is similar to the issues people had when Activision used the likeness of the late Kirk Kurt Cobain to sing Public Enemy songs.

No Doubt manager Jim Guerinot added that Activision...""transformed No Doubt band members into a virtual karaoke circus act".

Although, Jim...I think they were halfway there as it is.

    Oh Activision, you just can't stop getting sued can you.

    I hope it goes through, they need a kick until they realise they can't run wild.

    (Also, not to be picky, but Kurt Cobain, not Kirk Cobain :) )

    It would've been funnier if they were suing because they were banned from XBL because of Call of Duty.

    And Kirk Cobain makes me laugh.

    I'll be honest, I love the idea of anyone suing Activision nowadays. Hell, all I need is for Tom Cruise to sue Activision and for them to counter-sue Tom Cruise, and my two main enemies will sue each other out of existence!

    "Fuck activision" I forget the original reason from which the original use of this phrase came from on whichever 4pp podcast, but I continue to use it to this day.
